Terms of Service for Airmail

Welcome to Airmail (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, services, and any related content provided by Airmail.By using our website or services, you agree to these Terms. If you do not agree, please do not use our site or services.
1. Services ProvidedAirmail offers direct mail campaign management for real estate investors. Our services may include list building, creative design, printing, postage, delivery management, campaign tracking, and consultation.
2. EligibilityTo use our services, you must be at least 18 years old and legally able to enter into a binding contract. You agree to provide accurate and complete information when working with Airmail.
3. Payments and Billing
• All services are billed based on our cost-plus pricing model unless otherwise stated.
• Invoices are due upon receipt unless agreed to in writing.
• Failure to make timely payments may result in paused or canceled services.
4. Client ResponsibilitiesYou agree to:
• Provide accurate and complete information for campaign setup
• Review and approve mail pieces in a timely manner
• Use our services in compliance with all applicable laws and regulationsYou are solely responsible for the accuracy and legality of the mailing lists, messaging, and offers you approve.
5. Intellectual PropertyAll materials provided by Airmail—including designs, templates, copy, and branding—remain the intellectual property of Airmail unless otherwise agreed in writing. Clients may not reuse or reproduce Airmail materials outside the scope of the contracted campaign without permission.
6. No GuaranteesWhile Airmail uses proven strategies and tested creative, we do not guarantee specific results or performance metrics. Success depends on many factors, including market conditions, list quality, timing, and messaging.
7. Cancellations and RefundsDue to the custom nature of direct mail campaigns, all sales are final once production has started. Requests to cancel must be made before print or postage work begins. Refunds will be considered on a case-by-case basis for unrendered services.
8. Prohibited UseYou may not use Airmail’s services for:
• Illegal or fraudulent purposes
• Sending discriminatory, misleading, or abusive content
• Spamming or unsolicited marketing in violation of applicable lawsWe reserve the right to refuse service at our discretion.
9. Limitation of LiabilityTo the fullest extent permitted by law, Airmail is not liable for any indirect, incidental, special, or consequential damages, including lost profits or missed opportunities, resulting from your use of our services.
10. Modifications to TermsWe may update these Terms from time to time. Any changes will be posted on this page with a revised effective date. Continued use of our services after changes indicates your acceptance.
11. Governing LawThese Terms are governed by the laws of the state of California, without regard to its conflict of law principles.
